NAS DMCA Policy

1. Introduction
New Artist Source (“NAS,” “we,” “our,” “the Platform”) respects the intellectual property rights of creators, artists, and copyright holders. NAS complies with the Digital Millennium Copyright Act (“DMCA”) and provides a process for submitting copyright infringement notices and counter-notifications.
2. Copyright Infringement Notification (DMCA Takedown Notice)
If you believe your copyrighted work has been uploaded, posted, or distributed on NAS without authorization, you may submit a DMCA Takedown Notice. Your notice must include:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the infringing material, including URLs or direct links.
- Your contact information (name, address, phone number, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Incomplete notices may not be processed.
3. What Happens After NAS Receives a DMCA Notice
Upon receiving a valid DMCA notice, NAS will:
- Remove or disable access to the allegedly infringing content.
- Notify the creator who uploaded the content.
- Provide the creator with a copy of the notice.
- Allow the creator to submit a counter-notification.
- Place a temporary hold on related earnings.
- Document the incident for repeat-infringer tracking.
NAS may also suspend monetization or account access during review.
4. Counter-Notification (Restoration Request)
If you believe your content was removed in error or due to misidentification, you may submit a DMCA Counter-Notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the removed content and its location before removal.
- A statement, under penalty of perjury, that the content was removed or disabled as a result of mistake or misidentification.
- Your name, address, phone number, and email.
- A statement that you consent to the jurisdiction of the U.S. federal courts and will accept service of process from the original complainant.

5. What Happens After a Counter-Notification
After receiving a valid counter-notification, NAS will:
- Forward the counter-notification to the original complainant.
- Allow the complainant 10 business days to file a court action.
- Restore the content if no legal action is filed and restoration does not violate other NAS policies.
NAS may decline to restore content if the creator is a repeat infringer, the content violates other policies, or appears high-risk or fraudulent.
6. Repeat Infringer Policy
NAS will terminate accounts that receive multiple valid copyright complaints. Termination may occur after:
- Multiple DMCA notices.
- Repeated copyright violations.
- Evidence of intentional infringement.
- Uploading movies, TV shows, music videos, or other high-risk content without proper rights.
NAS reserves the right to determine what constitutes a “repeat infringer.”
7. Earnings Forfeiture for Infringing Content
If content is removed for copyright infringement:
- All earnings associated with that content are forfeited.
- NAS may reverse payouts.
- NAS may deduct losses from future earnings.
- NAS may issue refunds to buyers.
- NAS may place a hold on the creator’s account.
8. High-Risk Content Review
NAS may delay or deny monetization for content that includes:
- Commercial music.
- Movie or TV footage.
- Full-length films.
- Clips from copyrighted sources.
- Content from unverified creators.
NAS may require proof of ownership or licensing before enabling monetization.
9. No Legal Advice
NAS does not provide legal advice. Creators are responsible for understanding copyright law and ensuring they have rights to all uploaded content.
